Hi Guys,
I am working with company A on H1B, currently on bench (no pay, all vacation used up) and no pay stub. I got an from offer from Company B and have started the H1 transfer process. I would like to know how soon can I join company B. My friend says I can join as soon as USCIS receives the H1B application i.e. as soon as the fedex delivery reciept becomes available I can join the company B.
The lawyer from company B says I need to wait till a reciept notice is received from USCIS.
Who is right? I want to believe the lawyer for obvious reasons (she is a lawyer) but my friend did the similar thing, he joined the day his app was received at USCIS and he was adviced so by his company's lawyer.
A rationale to join on the same day is that when the H1 is approved it will have the start date same as the day USCIS received the app (as that is the requested start date of transfer).
I'd appreciate your inputs.

Yes, you can change your employer's from India but you need to go for stamping again at US Consulate and get a new VISA to enter into US.

Hello all,
For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:
there was a proposal a while ago to stop allowing concurrent filing, but I have only heard about filing of 485 without an I-140 from people who wish for that, nothing from USCIS.
Something like that requires a change in the law, its not a matter of USCIS policy

On Acceptance, your petitioner will receive the hardcopy (receipt notice) generally within 2-4 business days.

I'll throw in my very non-expert opinion here, having shot just a few weddings basically in your position.
The dress in the first shot is blown out. I might have angled the vertical dimension a bit lower to capture the full length portraits and avoid so much "dead space" at the top.
The composition on the second one is ok, but the eyes are rolling all over the room (bad grammar intentional). Since I've never shot in a paid position where I had the authority to exclude other photography during the group shots (not that I would even then), I generally defer first to the "guest" photographers, telling everyone to take their turn one at a time, and to speak up before the photo to get the subjects looking at them. Then I take over the attention and get everyone to look at me for however many shots I need to take of that pose. BTW, it's always good to take a few shots of each pose, because you're almost guaranteed to have closed eyes in different shots. I'm sure the pros will be in shortly to fill us both in on a better way to do this (I'd appreciate that, too). :)
The fill flash was done excellently, but the background is very contrasty and thus distracting.
This is just MHO, and probably doesn't amount to much. Also, please don't feel bad - I've made most of these mistakes myself (and managed to pull off some others that you didn't think of). :o ;)

I am interested as well. We can control our own destiny. What kind of issues can one get in RFE's for 485 that we wont be able to answer and the lawyer will? We need a copy of the Labor and 140. Don't we?

I filed for i-485 ON July 23rd along with the EAD and AP. My EAD got approved and got a RFE on AP. I haven't received my Finger Print notice yet. Will RFE on AP affect the FP?..
Is it normal that I haven't FP notice after almost closed to a month after the checks have been encashed?..
Any inputs are highly appreciated.

Usually, even if the employer or attorney put their address, the USCIS mails the card to the address marked as the home address of the applicant.
Note that the I-765(EAD) and AP are not mandatory forms. Talk your employer into saying "these are not required right now, we can file later". And once he files the 485 and 140, you can always file the EAD and AP yourself (or use a lawyer).
I have a feeling he's trying to keep all documentation to himself. Don't let your guard down.
Purely my opinion.
