Better option would be to get her to US on any non-immigrant visa. Get your citizenship & file for her GC.

My sister is planning to visit us here this summer. she is scheduled for visa interview next month. (me & my sister who is citizen ... are sponsoring her)
little caveat, my sister has filed immigration file for her (about 2 years back...it usually takes 10-15 yrs for sibling family visa). just want to know anyone has seen or encountered such case. (in her visitor visa forms we have disclosed all this, meaning immigration file number n all)
is there any specific question that they may ask....or does it make her in-eligible for visitors visa ?

I have renewed my DL in VA while my H1B was pending last year (Oct 07) . All you need is your H1-B application receipt and they will extend it by 1 Year.

My green card application is family based and my spouse is a primary applicant. I have a EAD as of now and I recently got laid off on January 15th 2010. My H1B VISA expired on January 23rd 2010.
Issue: I recently applied for Advance parole and got rejected. Reason was given that my I-485 is administratively closed.
My laywer has suggested that I should immediately apply for H4 to save my status. I am really not sure what to do here. I am sure I will find a job in about 2 weeks but not sure if I will be able to get my H1B renewed or will be able to get a new H1B as I have already been counted towards the quota once.
I also read that it depends on the approval of I-130 but in my case I couldn't find I-130 for myself, even though there is one for my spouse which was approved in 2007.
My questions are:
1: What steps should I take to save my immigration status?
2. My EAD is not denied yet, should I start working on EAD or apply for H1B right away?
3. Can my H1B be renewed as it has already expired?
4. I have had a EAD for over a year and all of a sudden it may get canceled. Is there a way I can appeal somewhere as a mistake was made my immigration itself?
5. Have you experienced any cases similiar to mine and what were the outcomes?
Please, let me know your thoughts as your expertise can certainly help me save my career.

I am about to switch to a new employer using AC21 and would work on EAD. I still have more than 2 years on my current H1B (i.e. I'm on 4th year right now).
Can I re-use my remaining H1B in case I need to in future? Because in case my I-485 gets a denial (which shouldn't be the case) I would be out of status!
My case:
sub-labor, 140 approved, I-485 pending for more than 1 year now.

Hello,
I need an urgent information. My visa stamping in my passport got expired, but I have valid I-797 document. I am planning to have my visa restamping in India. I came to know that with expired visa stamp we can not travel via UK and France. Can you please advice if I can travel via Frankfurt, Germany? or do I need to get a Transit Visa.
Anyone who has travelled through Germany with expired H1B visa stamp?
I have to travel within a week and I would appreciate your advice.

My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

I assume you are concerned about your wife's status so you are specifically asking if USCIS would consider July 1st RD. Now if you file again they will not consider the July 1st RD. They will stamp the actual date that they receive. Don't worry about that. Your wife is covered by the H1/H4 extension filing, have you received the receipts for the H extension filings? I assume you would have, it is almost 2 months now. Don't worry your wife's status is all valid.
Stay cool and apply for I-485 for your wife ASAP.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.

Since you applied for extension before your current H1 expired, you are allowed to continue to work for 240 days from the date of H1 expiry. If your H1 is still not approved, then I believe you will have to stop working but can still be in the country till a decision has been made on your petition. Your employer could try and upgrade your pending application to premium processing so you will get to hear from USCIS within 15 days.

My Case as of March 2010:
EB3 (India) applied with company A. PD: June 2004.
Labor approved, I-140 approved.
No EAD. Labor was not approved when EB3 dates became current
First issue of H1B March 2003
Currently have a 3 year H1B extension (beyond 6 years) due to run out in Nov 2011.
My Questions:
1. I am still working with Company A. Can I move to Company B, i.e. will I be able to transfer my H1B, which is now in its 8th year? If yes, will the transfer be valid till Nov 2011?
2. If I can move to Company B, do I have to file for a new GC right away? If not, by when?
3. Can this new GC be EB2 with the hope of porting the PD from my EB3 case from Company A? If yes, what is the criteria for such a port?
4. Anything else I should keep in mind if I can and do decide to switch to Company B?
All your help is greatly appreciated!! I have been sitting and just waiting for my EB3 to get current, which does not seem like a possibility now. Hoping that I can use an EB2 case.
